A recent demolition in Matina Crossing, Davao City last February 27, 2026 has displaced several families from the Upper Arroyo Compound, marking a painful moment for residents who have long lived in the area. However, the situation has become more complicated as homeowners from nearby Guadalupe Village claim that the demolition extended beyond what was authorized by the court.
The incident has raised serious legal questions about the scope of the demolition order and whether some houses were removed despite not being covered by the court directive, as questioned by the homeowners last March 5, 2026.

Legal Action Filed Before DARAB
Representing the affected homeowners, Atty. Jefferson Louie Pasagui confirmed that legal action has already been filed before the Provincial Agrarian Reform Adjudicator (PARAD) acts as the primary, exclusive, and original adjudicator for agrarian disputes within a specific province, operating under the DAR Adjudication Board (DARAB).
The case seeks to question the basis and scope of the demolition, particularly whether the demolition was lawfully implemented with respect to properties in Guadalupe Village.
According to Atty. Pasagui, the action aims to clarify whether the structures demolished were indeed covered by the court order and to determine whether proper procedures were followed.
DARAB Hearing Scheduled
The matter is now set to be addressed through legal proceedings. A hearing before DARABÂ is scheduled to proceed this week, where the parties involved are expected to present their respective positions and evidence.
The upcoming hearing is anticipated to help determine:
Whether the demolition in Guadalupe Village was legally justified
Whether the demolition exceeded the authority of the court order
What remedies may be available to affected homeowners
Legal Issues in Demolition Cases
Demolition cases often involve complex legal issues such as:
Validity and scope of court demolition orders
Proper identification of properties subject to demolition
Coordination with implementing officers such as sheriffs
Protection of homeowners’ rights
When disputes arise regarding the implementation of demolition orders, affected parties may seek remedies through courts or quasi-judicial bodies like DARAB.
The scheduled hearing this week is expected to play a crucial role in resolving the issue and determining the rights and remedies available to the homeowners involved.
